What Is Alimony in Delaware?

Alimony is financial support one spouse may have to pay the other after divorce. Its purpose is to reduce unfair financial hardship when one spouse is dependent on the other. In Delaware, alimony is governed by Title 13, § 1512 of the Delaware Code.

A judge considers several factors, including:

  • Each spouse’s income and expenses
  • Standard of living during marriage
  • Length of the marriage
  • Age and health of both spouses
  • Financial resources and employability
  • Any marital misconduct

Because there are many factors, no calculator can give a guaranteed number. But a calculator can help you understand likely ranges.

How the Delaware Alimony Calculator Works

The Delaware Maintenance (Alimony) Calculator is an online tool that takes a few key numbers and runs them through a guideline formula.

You enter:

  1. Payor’s Gross Monthly Income – Total before taxes/deductions
  2. Recipient’s Gross Monthly Income – Total before taxes/deductions
  3. Payor’s Monthly Deductions – Taxes, insurance, or mandatory deductions
  4. Recipient’s Monthly Deductions – Same as above
  5. Length of Marriage (in years)

Behind the Scenes Formula

Here’s what happens when you click Calculate:

  • The tool subtracts deductions from each spouse’s income to get net income.
  • If the payor’s net income is not higher than the recipient’s, alimony will likely be $0.
  • If alimony applies, the calculator estimates payment with this formula:
(Payor’s Net Income × 25%) – (Recipient’s Net Income × 30%)

This result is the estimated monthly payment.

Duration Estimate

The length of alimony depends on marriage length:

  • Under 20 years: Presumptive duration = 50% of the marriage length.
(Example: 10-year marriage → about 5 years of alimony)
  • 20 years or more: Alimony may be indefinite, but still subject to modification.

Example Calculation

Imagine:

  • Payor income: $8,000 (gross), $6,500 after deductions
  • Recipient income: $2,000 (gross), $1,800 after deductions
  • Marriage: 15 years

The calculator runs the formula:

($6,500 × 25%) – ($1,800 × 30%)
= $1,625 – $540
= $1,085 estimated monthly payment

Duration = 50% of marriage length = about 7 years, 6 months.
